Competition Period 12.01am (AEDT) on 09/02/2024 to 11.59pm (AEDT) on 29/02/2024.
Who can enter? Only Australian residents who are aged 18 or over.
Who can't enter? Directors, officers, management, employees and contractors (and their immediate families) of:
  1. (a)the Promoter; and
  2. (b)the agencies, companies or participating premises associated with this competition.
Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Entry instructions To enter, you must, during the Competition Period:
  1. (a)visit the Website and follow the prompts to locate the entry page and fill out and submit the online entry form (including a valid AU mobile number) and providing all other requested information);
  2. (b)tick the opt-in box to sign up to receive future marketing and communications from the Promoter; and
  3. (c)answering in 25 words or less, "What Oreo flavour would you love next and why?" (“Submission”).
The Promoter is not responsible if your mobile device/desktop is not sufficiently capable for the purpose of submitting an entry.

Please note, no credit or attribution will be granted to an entrant if their submission is developed by the Promoter.

Signing up the Promoter's database (and consequently, participation in this promotion) is subject to the Promoter's Privacy Policy which is available at au.mondelezinternational.com/privacy-policy as amended from time to time.
How many winners will there be and how will they be chosen? This is a game of skill. A judging panel appointed by the Promoter will review each valid entry and will judge the entries based on creativity and originality to determine the winners. Chance plays no part in how the winners will be selected.

The 500 valid entries judged to have the best Submission will win a prize.

All judging decisions are as determined by the Promoter, in their absolute discretion.
What can I win There are 500 prizes available.

Each prize is a $2.50 Digital Vault Pays-enabled Prepaid Mastercard® to use to purchase a packet of Oreo cookies (RRP $2.50) at any retailer in AU that stocks Oreo biscuits and that accepts digital Mastercard payments.

Any ancillary costs associated with redeeming the Digital Vault Pays-enabled Prepaid Mastercard are not included. The Digital Vault Pays-enabled Prepaid Mastercard must be activated within 2 months of issue and is valid for 12 months after activation. At expiry of the Digital Vault Pays-enabled Mastercard any unused balance will be forfeited. You will not receive notice prior to expiry. Card expiry and balance can be found on your mobile device in your digital wallet. The Digital Vault Pays-enabled Prepaid Mastercard is issued by EML Payment Solutions Limited (ABN 30 131 436 532) AFSL 404131 pursuant to license by Mastercard. Upon verification, the prize will be sent to the winners by SMS (to the mobile phone number specified on the winner's entry form). Winners then need to activate the card using the Vault app – activation code will be provided in SMS. Once activated, the card can be added to the winner's phone’s digital wallet (e.g. Apple Pay, Google Pay or Samsung Pay) and can be used for purchasing goods and services where the card is accepted for electronic transactions (excluding transactions at ATMs or over the counter at financial institutions). The card cannot be used as a credit card and cannot be linked to any deposit account.

There is a limit of one prize per person.

How many times can I enter? You can only enter once.
How and when will the winners be informed? Winners will be notified in writing by email within 5 business days of determination.
Unclaimed prizes There will be no unclaimed prizes. All prizes will be automatically awarded to winners via SMS to the mobile number associated with their entry. It is an entrant's responsibility to ensure that they enter their mobile number correctly. If they fail to enter their mobile number correctly, the prize will be forfeited. Any un-won prizes remaining at the end of the competition will be forfeited by the Promoter.
Collection and use of your personal information The Promoter may collect your personal information directly or through its agents or contractors. The Promoter will use your personal information to conduct and manage the competition. The Promoter may disclose your personal information to its related companies, agents and contractors to assist in conducting this competition, communicating with you or storing data or to hold and use for fraud prevention purposes. This may include disclosures to organisations outside Australia including in places such as New Zealand, Switzerland, Singapore, United Kingdom and the United States of America.

In addition to any use that may be outlined in the Promoter’s Privacy Policy (see au.mondelezinternational.com/privacy-policy), the Promoter may, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the individual. The individual will be able to opt out at any time.

The Promoter’s Privacy Policy includes information about:
  1. (a)how to seek access to the personal information the Promoter holds about you and seek correction of the information; and
  2. (b)how to complain about a privacy breach and how the Promoter will deal with such a complaint.

  1. These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about prizes and how to enter forms part of these Terms and Conditions. By entering, you accept these Terms and Conditions.
Entry
  1. Your entry must be received during the Competition Period and will be deemed to be received only when received by the Promoter. You will receive a return message confirming your entry. The Promoter is not liable for any problems with communications networks outside its reasonable control. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified.
  2. Every entry, including any “25 words or less” statement (the Submission), must only contain entirely original work and must not be copied in whole or in part. Entries must not be created using any generative artificial intelligence software.
Intellectual Property
  1. By submitting your competition entry, and in consideration for the Promoter considering your Submission, you:
    1. (i)agree that, you automatically from the time you submit your competition entry, assign all rights, title and interest in and to the Submission, including but not limited to trade marks copyright and other intellectual property rights, on a worldwide basis, to the Promoter and that you will undertake all necessary steps to give further effect to this assignment;
    2. (ii)consent to any act or omission by the Promoter or its affiliates or any of their respective representatives, partners, licensees, sublicensees or successors in title, which would otherwise infringe any Moral Rights (as defined in the Copyright Act 1968 (Cth)) you hold in respect of any Submission or other works contained in your entry; and
    3. (iii)warrant that your Submission does not breach any third party rights (including intellectual property rights) and its use by the Promoter or any other person as permitted by these Terms and Conditions will not breach such rights nor otherwise breach any law (for example, it is not defamatory, in contempt of court or in breach of any privacy law).
  2. The Promoter may decide not to publish a Submission, to cease publication of a Submission, or to publish an edited Submission.
  3. Your entry must not be obscene, offensive, malicious, discriminatory, indecent or (in the Promoter's opinion) otherwise objectionable or inappropriate (for example, it must not include nudity or language the Promoter deems offensive).
Prizes
  1. The prize and all elements of the prize must be taken as specified, as and when offered and cannot be altered or changed in any way by you or will be forfeited, and if forfeited, the Promoter will not be liable. If you forfeit the prize or any element of the prize for whatever reason, you will not be given cash or any alternative prize as a substitute. The prize is subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including, as relevant validity periods.
  2. The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share a prize.
General
  1. If you or your entry are deemed by the Promoter to breach these Terms and Conditions materially, your entry (or at the Promoter's discretion, all of your entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's reasonable satisfaction the validity of your entries and/or verifying your identity (including documentation establishing your identity, age, place of residence, and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
  2. You must not:
    1. (a)Tamper with the entry process (including but not limited to manipulating the system via bots, script use, or any other means to circumvent the entry process);
    2. (b)Engage in any conduct that may jeopardize the fair and proper conduct of the competition;
    3. (c)Act in a disruptive, annoying, threatening, abusive, or harassing manner;
    4. (d)Do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;
    5. (e)Breach any law; or
    6. (f)Behave in a way that is otherwise inappropriate.
  3. The Promoter is not liable for entries, prize claims, or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible, or incorrectly submitted for reasons outside the Promoter's reasonable control.
  4. If any dispute arises between you and the Promoter concerning the conduct of this competition or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time. In all other respects, the Promoter’s decision in connection with all aspects of this competition is final.
  5. Prizes cannot be transferred or exchanged nor redeemed for cash. Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value. You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.
  6. If this competition cannot run as planned for any reason beyond the Promoter's control (for example due to software, hardware or communications issues, unauthorized intervention, tampering, fraud, or technical failure, government directives, a pandemic, public health orders and the like), the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities.
  7. The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
Liability
  1. You may have consumer rights under statute including under the Competition and Consumer Act 2010 (Cth), which may be relevant to any issue or problem you encounter in relation to this competition and cannot be excluded or restricted. Nothing in these Terms and Conditions excludes or restricts those rights. See www.accc.gov.au for more information about those rights.
  2. Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including allergies, skin conditions or other reactions, as relevant), illness, or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
  3. Without limiting the previous paragraphs, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to, or delay in the delivery of prize/s, or for any damage that occurs to displayed prize/s (where relevant), due to circumstances beyond the Promoter's reasonable control. Unless otherwise specified, prize/s will only be delivered to addresses in Australia.
  4. This competition is in no way sponsored, endorsed, or administered by, or associated with any social media platform, including Facebook, Instagram, and Twitter. You provide your information to the Promoter and not to any social media platform. You completely release any relevant social media platforms from any and all liability.
